1. Acceptance of Terms

By accessing or using the Hebbian platform at hebbian.ch (the "Platform"), including our learning management system, online courses, workshops, and related services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform.

If you are using the Platform on behalf of an educational institution or organization, you represent that you have the authority to bind that organization to these terms.

2. Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

Accounts for minors participating in school programs may be created by their educational institution with appropriate parental or guardian authorization.

3. Acceptable Use

You agree to use the Platform only for lawful purposes. You may not:

• Submit fraudulent, plagiarized, or AI-generated work as your own in exercises or assignments, unless expressly permitted by the course instructions
• Share your account credentials or allow others to access your account
• Upload harmful, offensive, or illegal content
• Attempt to reverse engineer, decompile, or disassemble any part of the Platform
• Interfere with or disrupt the Platform's infrastructure or other users' experience
• Scrape, harvest, or collect data from the Platform through automated means
• Use the Platform to distribute spam, malware, or unsolicited communications

We reserve the right to suspend or terminate accounts that violate these terms.

4. User Content & Submissions

You retain ownership of any content you submit to the Platform, including exercise responses, assignment submissions, and uploaded files. By submitting content, you grant Hebbian a non-exclusive, royalty-free license to use, store, display, and process your content for the purposes of:

• Delivering and administering courses and programs
• Enabling teachers and mentors to review and grade your work
• Improving the Platform and educational materials

You are responsible for ensuring that any content you submit does not infringe on third-party intellectual property rights. We reserve the right to remove content that violates these terms.

5. AI-Powered Features

The Platform includes AI-powered learning tools that provide educational assistance. When using these features, please be aware that:

• AI-generated responses are educational aids and should not be treated as professional, legal, medical, or financial advice
• AI outputs may contain inaccuracies and should be verified independently when used for important decisions
• Your prompts and queries are processed by third-party AI providers (including OpenAI, Anthropic, and Google) as described in our Privacy Policy
• You should not submit sensitive personal information (e.g., financial details, government ID numbers) through AI features

6. Intellectual Property

All Platform content, including course materials, videos, text, graphics, logos, and software, is the property of Hebbian or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may access and use course materials for your personal educational purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Platform content without our prior written consent.

7. Payments & Refunds

Some courses and programs may require payment. All prices are listed in Swiss Francs (CHF) unless otherwise stated. By making a purchase, you agree to pay the full amount at the time of enrollment.

Refund requests may be submitted within 14 days of purchase by contacting us at [email protected]. Refunds are evaluated on a case-by-case basis and may be prorated based on course access and progress.

8. Organizational Accounts

Educational institutions and organizations that use the Platform are responsible for:

• Obtaining necessary consent from students, parents, or guardians before enrolling users
• Ensuring that their use of the Platform complies with applicable education and data protection laws
• Managing their administrators, teachers, and student accounts appropriately

9. Availability & Modifications

We strive to keep the Platform available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Platform at any time, with or without notice.

We reserve the right to update course content, features, and pricing. Significant changes to these Terms of Use will be communicated through the Platform or via email.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Hebbian and its founders, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:

• Loss of data, profits, or business opportunities
• Errors or inaccuracies in AI-generated content or course materials
• Interruptions or delays in Platform availability
• Actions of other users or third-party services

The Platform and its content are provided "as is" and "as available" without warranties of any kind, express or implied.

11. Indemnification

You agree to indemnify and hold harmless Hebbian and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these terms, or infringement of any third-party rights.

12. Termination

You may close your account at any time by contacting us at [email protected]. We may suspend or terminate your account if you violate these terms or engage in conduct that we determine is harmful to other users or the Platform.

Upon termination, your right to access the Platform will cease. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

13. Governing Law & Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from or relating to these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
